PIERRE, S.D. – South Dakota Attorney General Marty Jackley announced that a state circuit court has ruled a lawsuit against Mayday Health regarding allegations of deceptive and unlawful abortion pill advertisements will proceed to trial.

The ruling follows a series of legal maneuvers between the state and the organization. Jackley initiated the legal process in December by issuing a cease and desist letter to Mayday Health. The Attorney General alleged that the group engaged in deceptive advertising concerning the availability of abortion pills within South Dakota, where such services are prohibited by law.

“South Dakota’s circuit court is the proper place to enforce South Dakota law, and we look forward to presenting our evidence at trial,” Jackley said.

In addition to the cease and desist letter, Jackley filed a motion in state court seeking to halt advertising he described as either untruthful or contrary to South Dakota statutes. Mayday Health initially sought to block the state’s actions by filing for an emergency temporary restraining order in a New York U.S. Federal Court.
